1. Introduction

1.1 The terms and conditions on this page (the “Terms”) apply to our Welcome Reward 2020 promotion (“Promotion”). Please also see our Privacy Policy which describes how we use your personal information in connection with the Promotion and your data protection rights.

1.2 The promoter of the Promotion is Aquavista Watersides Ltd (“we”, “us”, “our” or “BWML” as applicable). You can find our company and contact details at the end of these Terms.

1.3 Please read these Terms carefully as, by entering the Promotion (by quoting ‘Rewards20’ when enquiring with us), you will be deemed to have accepted these Terms and agreed to be bound by them. You shall at all times comply with these Terms.

1.4 We recommend that you print a copy of these Terms for future reference. You can contact us in relation to the Promotion or request a copy of these Terms by writing to us using the contact details at the end of these Terms. If you would like to receive a copy of these Terms by post, you will need to provide us with a stamped self-addressed envelope.

1.5 Any complaints regarding the Promotion should be sent to us using the contact details at the end of these Terms.

2. Eligibility and participation

2.1 The Promotion is available from 00:00 on 8 June 2020 and will end on 23:59 on 1 October 2020 (“Promotion Period”). Any contracts entered into with Aquavista outside of the Promotion Period will not be eligible for the Promotion.

2.2 To be eligible for the Promotion, the following criteria must apply:

2.2.1 you must purchase a leisure or residential mooring licence by entering into the applicable contract with Aquavista, with a minimum duration of 12 consecutive months and which must commence on or before 1 October 2020 (“Eligible Contract”);

2.2.2 you must be a new customer to Aquavista (which means that you have never entered into any type of contract with us previously); and

2.2.3 you must be aged 18 or over.

2.3 To enter the Promotion, you must quote ‘Rewards20’ at the time you enter into the Eligible Contract, either online, over the phone or in person.

2.4 The Promotion cannot be claimed retrospectively, for example, in respect of Eligible Contracts entered into prior to 8 June 2020 or in any circumstances where you did not quote ‘Rewards20’ before entering into the Eligible Contract.

2.5 The Promotion is subject to mooring availability.

2.6 By entering the Promotion, you promise that all information submitted by you is true, accurate, current and complete. We reserve the right to verify your eligibility to enter the Promotion, during and/or after the Promotion Period (including verifying entrants’ identity, age and address).

2.7 We reserve the right not to provide the reward to you, or to deactivate your reward, if we are aware or have reasonable grounds to believe that you were ineligible to enter the Promotion at the time of entry.

2.8 Any entries from participants who we reasonably believe have acted unfairly will be disqualified. Aquavista reserve the right to disqualify any entries that it deems to be suspicious or achieved through manipulation of the Promotion or any of the platforms that it is made available through. Should the reward be obtained, and the Eligible Contract does not successfully commence, Aquavista reserve the right to invoice the applicant to the value of the reward received or for the value of the products obtained using the reward, whichever is lower.

2.9 Our decision is final and no correspondence on any matter concerning the Promotion will be entered into.

3. The reward

3.1 The reward for eligible participants that have entered the Promotion is a coupon for use exclusively at https://britmarine.net/product-category/welcome-rewards/ (“Reward Site”). The coupon allows you to purchase selected products as displayed on the Reward Site from time to time. A purchase can be made using a combination of the coupon and cash (if the total amount of the order exceeds the coupon value). All products are subject to availability and we reserve the right to amend, add or remove any products from the Reward Site at any time throughout the Promotion Period. Please be aware that available products may vary by marina (for example, fuel vouchers are only available at selected marinas). If any products that you have purchased from the Reward Site become unavailable, we will notify you by e-mail within 7 working days from the date of your order and we will re-issue a coupon to you at the original value of the unavailable product and, if applicable, refund any sums paid by you to the original payment method.

3.2 The value of the coupon will depend on which type of Eligible Contract is purchased, as follows:

3.2.1 Leisure mooring licence = £250 coupon value

3.2.2 Residential mooring licence = £500 coupon value

The coupon is not a credit, therefore the value of the coupon must be used in a single transaction. Any unused amount will not be credited to you and you will lose the remaining amount of the coupon.

3.3 Your reward coupon will be sent at the same time we send the confirmation of entry into the Eligible Contract to the email address you have provided to us in connection with that contract. You must use your coupon (or re-issued coupon) within 14 days of receipt, after which time the coupon will expire and is forfeited.

3.4 Any orders placed on the Reward Site using your coupon will be delivered to the address provided to us for the Eligible Contract.

3.5 The terms of use and sale governing orders and purchases from the Reward Site shall apply to the purchase of any products using your reward coupon. You may access those terms at https://britmarine.net/terms-conditions/. If you receive a product which is faulty, we will replace that product upon receipt of the faulty product from you or we will re-issue a coupon to you at the value of the returned product. This does not affect your legal rights.

3.6 Rewards are non-transferable, non-resaleable and non-negotiable and cannot be refunded, exchanged or amended and have no cash alternative.

3.7 The Promotion is for personal and consumer use only.

4. Our liability

4.1 We do not accept any responsibility for any damage, loss, injury or disappointment suffered by you as a result of you entering the Promotion or accepting any reward.

4.2 Nothing in these Terms shall exclude our liability for death or personal injury as a result of our negligence or for fraud or fraudulent misrepresentation or for any other liability that cannot be limited or excluded by applicable law.

5. Your personal information

5.1 As a result of your participation in the Promotion, we will collect certain personal information relating to you. Please see our Privacy Policy for information regarding the personal information we collect from you and the purposes for which we use that information. We will process the information about you in accordance with that policy. As described in our Privacy Policy, we will share some of your personal data with our suppliers assisting with the conduct of the Promotion, the fulfilment of the rewards and the sale of products to you.

6. Changes to the promotion or these terms

6.1 We may modify, suspend or terminate the Promotion, extend its closing date or time or make any other changes to the Promotion or Terms only in the event of circumstances arising that are outside of our reasonable control.

6.2 Where reasonably possible, we will notify you of such changes in advance or at the time we make such changes by posting amended Terms on this page.

7. Governing law and jurisdiction

7.1 The Promotion and these Terms are governed by the laws of England and Wales.

7.2 You can bring legal proceedings in respect of these Terms in the courts of England and Wales. If you live in Scotland you can bring legal proceedings in respect of the Terms in either the Scottish or the English courts.
